The interrelation of domestic law and international law in the protection of the environment and public health: a study based on ajax case

In 2013, the case of the company Acumuladores Ajax Ltda. was the subject of an important judgment ruled by the Superior Tribunal de Justiça. Defeated in the lower courts, the company filed motions for execution with the purpose of contesting a fine that had been imposed due to the practice of environmental infringement: the activity carried out exposed the population residing in the vicinity of the company's headquarters to lead contamination. The authorities responsible for sanitary and environmental inspection identified in this population blood levels above those established by the recommendations issued by the World Health Organization principle of in dubio pro salute. Although the Brazilian parameters for the use of lead were less strict, the Superior Tribunal de Justiça understood that the World Health Organization guidelines should prevail, in the name of the hermeneutic principle in dubio pro salute. From a descriptive documental research, the objective of this work is to analyze the protection of the rights to public health and to a healthy and ecologically balanced environment through a critical reading of the case in question, aiming to identify the impact of international norms on Brazilian law and the consequent construction of interpretive parameters for the resolution of demands of this nature. It is concluded that the in dubio pro salute principle is fundamental for an effective protection of fundamental rights both by contributing to a national jurisprudence aligned with international bases and by guaranteeing an extensive protection of the rights to the environment and public health.
