The pretential objectivity and impartiality of the simple legal narrative

This paper aims to prove that objectivity and impartiality, text qualities usually associated with some type of texts, such as the legal narratives, are a kind of abstraction, since every text presupposes subjectivity. This position, in fact, is not new, but shared by linguists whose researches take into consideration the process of enunciation. In this sense, linguistic structures always exhibits perspectivization, even when lexical selection does not have to do with modalization or deictic material. Thus, we argue that other factors operate in the expression of subjectivity, such as categorization, conceptualization of scenes and the use of argumentative operators. To test our hypothesis, we analyzed some legal texts that were written in order to obtain objectivity and impartiality.Downloads
