Human rights and democracy: a necessary relation

Abstract

Based on the assumption that there is a direct relationship - although not absolute or logical - between human rights and democracy, this article aims to demonstrate that the democratic regime adopted by the 1988 Constitution is not restricted to its procedural aspect, but rather promoting and protecting the rights of all. In this way, any and all attacks on human rights represent in the same proportion an attack on democracy itself and it is necessary to strengthen the interdependent relationship between the two in order to strengthen Brazilian democracy. To this end, the literature review was adopted as a research methodology. At first, the relationship between the concepts was analyzed from the predominant point of view when the emergence of human rights. Afterwards, the insufficiency of this vision was exposed, aiming to outline what are the possible relations between human rights and democracy. We conclude that it is only possible to speak of an interdependent relationship between concepts based on a conception of democracy as a substantive democracy.
