For a New Legal Geography: Milton Santos and the Scales in the Rule of Law

Abstract

This article explores the hypothesis that Milton Santos' thought, articulated through the global, territorial, regional, and local scales, provides a theoretical framework for understanding the interaction between space and Law within the Rule of Law. By offering a systematic overview of his work, with abbreviations, the text demonstrates how these scales can guide legal professionals in analyzing and regulating territory. At the global scale, the relationship between globalization and human rights highlights the need to preserve local specificities amidst global economic dynamics. At the territorial scale, Administrative Law is identified as a pathway to integrate social and economic demands, fostering spatial justice. At the regional scale, the possibility of harmonizing local and national interests is underscored through tools such as regional master plans. Finally, at the local scale, Urban Law is interpreted as a means to ensure inclusive development and territorial justice. The study suggests that the scalar approach equips legal practitioners to locate phenomena and delimit the State's coercive powers contextually, expanding the understanding of territory as a space for citizen-building and the realization of fundamental rights.

Foi investigador do Centro de Investigação em Justiça e Governação (JusGov) da Escola de Direito da Universidade do Minho (Portugal); da Chaire Normandie pour la Paix junto a Université Caen Normandie (França); Professor Colaborador Sênior, junto ao Programa de Pós-Graduação em Geografia da Universidade de Brasília (UnB); e professor de Direito da Energia na Universidade Candido Mendes (UCAM/RJ, Brasil).
