Controle jurisdicional do ato administrativo

Trata-se de artigo destinado a fomentar o debate acerca da possibilidade de interferência do Poder Judiciário sobre o mérito do ato administrativo discricionário, a importância do tema reside na disparidade de entendimentos jurisprudenciais emitidos pelos juízes federais de primeiro grau, Tribunais Regionais Federais, Superior Tribunal de Justiça e Suprema Corte. No exame do tema, discorreu-se sobre a evolução histórica do princípio da separação dos poderes e sua importância como lastro das liberdades individuais frente à intervenção estatal. Bem como, revisou-se as diferentes correntes doutrinárias a respeito da revisão do mérito do ato administrativo pelo poder judiciário e a recente decisão proferida pelo Supremo Tribunal Federal, no julgamento do Recurso Extraordinário nº 592581, que determinou a implementação de medidas concretas que garantam a dignidade da pessoa humano frente a inércia do Poder Executivo.Downloads
