Abstract

O garantismo é uma palavra que está enraizada na linguagem fi losófi co-jurídica do pós-guerra italiano como componente essencial do constitucionalismo moderno. O Garantismo se tornou nome da teoria liberal do direito penal e se liga a Luigi Ferrajoli, incluindo Direito e Razão. O neoiluminismo criminoso se encaixa nesse conjunto de garantias processuais em paradigma normativo em um complexo que visa proteger os indivíduos de misericórdia ajustando o poder punitivo do Estado. O garantismo parece ser a teoria do sistema de garantias de direitos fundamentais, que analisa, aprimora e desenvolve o regime jurídico necessário para a protecção dos direitos civis, políticos, sociais e da liberdade sobre os quais hoje vivem as democracias constitucionais.
