THE FUNDAMENTAL RIGHT TO PERSONAL DATA PROTECTION:
ANALYSIS OF THE PARADIGMATIC DECISION FROM STF IN ADI 6.387-DF

The research theme is about the fundamental right to personal data. This paper considers that this legal good, essential in society’s life in the 21st century, requires a specific and qualified protection. The investigation aims to analyze the paradigmatic decision from Federal Supreme Court (STF), entered in ADI 6.387-DF which recognizes the existence of an autonomous fundamental right in protection of personal data. The research was developed from liberal theories and from the social state about the fundamental rights. It was applied the hypothetical-deductive method dealing with books, papers and the judgment proclaimed by STF. The study points to the existence of legitimacy in the creation of an autonomous fundamental right by the Court’s decision, recognizing to this right the same administration inherent to the other fundamental rights expected in the Federal Constitution.
