A lei Maria da Penha apresenta grandes méritos no que diz respeito às medidas de prevenção e de proteção da mulher, mas contém grandes falhas no campo penal. Estigmatiza os sujeitos envolvidos, oferecendo falsas soluções e nem sempre satisfaz a vítima, que muitas vezes deixa a justiça com o rótulo de que 'gosta de apanhar'. Não é através do direito penal que a mulher encontrará igualdade, pois as mudanças de comportamento e de mentalidade vêm através da educação e de ações preventivas. O direito penal deve ser o último recurso nos conflitos domésticos e familiares e só deve ser invocado depois de esgotadas as medidas de direito civil.Downloads
