O exercício do poder familiar após o desenlace conjugal por meio do instituto jurídico denominado guarda

O presente artigo analisa o contexto legislativo, doutrinário e jurisprudencial no qual se insere o exercício do poder familiar. Com isso, aponta os fatores históricos, conceito, características, responsabilidade civil, suspensão, extinção, destituição e incapacidade referentes ao poder familiar (atualmente denominado autoridade parental). Também traz apontamentos sobre as conseqüências do desenlace conjugal na execução do poder familiar. Ainda, estabelece algumas considerações sobre o princípio do melhor interesse do menor Finalmente, menciona o conceito, as espécies, a evolução histórica e a legislação atualizada (Estatuto da Criança e do Adolescente, Código Civil de 2002, com alterações trazidas pela Lei nº 11.698, de 13 de junho de 2008 e Código de Processo Civil) sobre a guarda de menores, sob o respaldo do princípio do melhor interesse do menor.Downloads
