A problemática da reflexão que se pretende desenvolver aqui se expressa na seguinte interrogação: é possível conciliar o imperativo universal dos elementos jurídicos, presentes no Direito, com o princípio antropológico da necessidade de se compreender a vida social a partir do particular? Num primeiro momento, esta questão parece indicar uma certa tendência à resposta negativa. Afinal, como ordenar uma norma de conduta universal, por meio de leis, numa sociedade, como a contemporânea, caracterizada por uma infinidade de valores morais e culturais? Partindo de tais interrogações é que será desenvolvido o presente artigo.Downloads
