O Decreto nº. 3.931/2001, que regulamenta o Sistema de Registro de Preços em âmbito federal, instituiu a figura do “carona”, a quem é facultada a utilização da ata de registro de preços de outro ente, sem ter participado do respectivo certame licitatório, comprovada à vantagem. Em decorrência da análise de sua natureza jurídica em face dos preceitos norteadores das contratações públicas, o instituto do “carona” é polêmico, portanto seu estudo é feito a partir de considerações da doutrina administrativista, da Advocacia Geral da União e, especialmente, da jurisprudência do Tribunal de Contas da União.Downloads
