Impeachment en Brasil pos-Dilma: ¿Ulises desatado por Hermes? el “canto de las sirenas” hermenéutico-constitucional

El presente artículo discute las posibilidades hermenéuticas de la interpretación constitucional del mecanismo del impeachment en Brasil tras la conclusión del juicio de la ex Presidente Dilma Roussef. Para ello, establece comparaciones entre el impeachment y otras formas de destitución de gobernantes. Con el objetivo comparativo, aborda el caso del ex Presidente Fernando Lugo, de Paraguay, ante sus grandes semejanzas con el reciente caso brasileño. Este es abordado en seguida a partir de la lectura hermenéutica constitucional clásica y lo que denominamos "mutación constitucional a la paraguaya", para, al fin, reflexionar sobre las posibilidades y los límites de esta última, considerando relevantes cuestiones del Estado constitucional y democrático de derecho como la estabilidad institucional y la seguridad jurídica.Downloads
