The Influence of the Pan African Movement for the International Protection of Refugees

The international refugee regime was strengthened by the 1951 Refugee Statute, which considered as refugees those individuals who left Europe before January 1, 1951, fearing persecution on grounds of race, religion, nationality, membership of a particular social group or political opinion, and by the Additional Protocol of 1967 which removed geographical and temporal restrictions from this concept. However, a massive influx of Third World refugees did not fit this concept, which gave rise to local initiatives to resolve the issue. This work aims to examine the influence of the Pan-Africanist movement on the international protection of refugees. The analysis of international norms is carried out in the light of the dialogue between post-colonial, de-colonial theoretical references, the “TWAIL”, to, in a deductive way, formulate conclusions. It examines the Pan-Africanist movement, the formulation of the 1969 OAU Convention, which broadened the concept of refugee to include migrants because of external aggression, occupation, foreign domination, or other events that seriously disturb public order. Finally, is described the impact of the African Convention on the formulation of the Cartagena Declaration of 1984.Downloads
