The construction of the Republic: the positivist bases of National Law in Martins Júnior

In Brazil, as the advertising for the new politics changed into the making of new legal codes, the positivism was one of the most adapted and reinterpreted in the imperialist context in the country. One of the thinkers that most contributed to its propagation in Brazil was the North republican leader, José Isidoro Martins Júnior. This article has as main goal, the analysis of ‘História do Direito Nacional’ (History of National Law) (1895) by Martins Júnior, synthesis of his work as teacher and leadership of the new generation that would think the new legal codes, helping to understand how the belief holding group of ‘civilized Europe’ has influenciated the formation of Brazilian Republic.Downloads
