National medicine policy and judicialization: an analysis of (non)compliance with access to healthcare

Abstract

This article aims to understand the national drug policy in Brazil within the context of judicialization. A growth in lawsuits related to access to medicines is observed, a phenomenon that highlights tensions between the implementation of public policies and the guarantee of the fundamental right to health ensured by the 1988 Federal Constitution. The research adopts a qualitative-quantitative approach; qualitative because we develop a historical perspective on the construction of the policy in the country, considering the regulations that have emerged since the 1988 Constitution, and quantitative because we collect data on lawsuits requesting medicines. The specific objectives planned were: a) to understand the public health policy in Brazil, with the implementation of the National Drug Policy; b) to analyze the phenomenon of judicialization resulting from non-compliance with the guidelines and goals established by the National Drug Policy, considering the factors that lead users to resort to the Judiciary. c) To investigate 14 cases in which the violation of the right to access medication was brought to court in the São Borja-RS district between January 2020 and December 2020. The results show that litigation, while constituting a mechanism for guaranteeing rights, also reveals weaknesses in the implementation of public health policies.
