Right and access to mental health in the realization of trans children and teenagers’ personality rights

Abstract

The present paper aims to analyze the right and access to mental health of transgender children and adolescents, in order to preserve their personality rights. The nonconformity between the socially imposed gender and the gender understood as theirs can still occur at these stages, a time that can generate trauma and mental disorders due to the intolerance suffered. Through a deductive method and literature review, it was verified the need for public policies or the adaptation of the existing ones to achieve these rights in the public health sphere. Although the possibility of creating specific norms to make this protection more robust was raised, reactionary ideas permeate Brazilian society, making it difficult to approve a law in this sense. This reactionarism also prevented public health policies for the LGBTQIAPN+ population from developing and, combined with the capitalist system, also hindered public policies in the mental health area in general.
