The inevitability of conflict, from a non-pathological perspective, contributed to the search for a peaceful coexistence among citizens. The conceptions regarding the formation of the State, within the perspective of the contractualist philosophers Thomas Hobbes (1588-1676), John Locke (1632-1704) Jean-Jacques Rousseau (1712-1778) occurred from the relationship between man and conflict. The way in which people, having become citizens, perceive conflicting relationships and the possibilities for a third party to mitigate them, is at the essence of the creation of the modern State and justifies the existence of the entire justice system, especially the Judiciary. From a re-reading and bibliographical research, the philosophical perspectives that contribute to the formation of the concept of citizenship and State are analyzed in this work.
